1. Introduction and Acceptance of Terms

Welcome to AgentForms (agentforms.dev). These Terms of Service ("Terms") govern your access to and use of the AgentForms platform, including the API, website, documentation, and all related services (collectively, the "Service"). By registering for an API key, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

AgentForms reserves the right to refuse service to anyone for any reason at any time.

2. Definitions

• "Service" refers to the AgentForms platform, API, website, documentation, and all related tools and services provided at agentforms.dev.
• "API" refers to the AgentForms application programming interface that enables programmatic creation and management of forms and retrieval of responses.
• "User" or "Customer" refers to any individual or entity that registers for an API key and uses the Service to create forms and collect responses.
• "Form" refers to a web-based form created through the API that collects structured input from human respondents.
• "Form Respondent" refers to any individual who fills out and submits a Form created through the Service.
• "API Key" refers to the unique authentication credential issued to a User upon registration, used to authenticate requests to the API.
• "Customer Data" refers to all data submitted by Form Respondents through Forms created by a User, including form responses, metadata, and any associated information.

3. Account Registration and API Keys

To use the Service, you must register for an API key via the API. Registration is limited to one API key per IP address. No email address is required for registration on the Free plan.

You are solely responsible for:

• Keeping your API key confidential and secure.
• All activity that occurs using your API key, whether or not authorized by you.
• Notifying AgentForms immediately if you believe your API key has been compromised.

AgentForms is not liable for any loss or damage arising from unauthorized use of your API key. You must not share, publish, or embed your API key in publicly accessible code, client-side applications, or repositories.

4. Service Description

AgentForms is an API-first platform that enables AI agents and software applications to create web forms, collect structured human input, and receive JSON responses. The Service provides:

• A REST API for creating, managing, and retrieving forms and responses.
• Hosted form pages that can be shared with human respondents.
• Webhook support for real-time notifications when forms are submitted.
• An MCP server for integration with AI assistants and development tools.
• Multiple field types for structured data collection.

5. Subscription Plans and Billing

AgentForms offers the following subscription plans:

• Free — No cost, with usage limits as described in the documentation.
• Pro — $19 per month.
• Team — $49 per month.
• Unlimited — Custom pricing, contact us for details.

All paid subscriptions are processed through Lemon Squeezy, which acts as the merchant of record for all billing transactions. By subscribing to a paid plan, you also agree to Lemon Squeezy's terms of service. Lemon Squeezy handles payment processing, invoicing, tax collection, and refunds on behalf of AgentForms.

Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel your subscription at any time through the billing portal provided by Lemon Squeezy. Cancellation takes effect at the end of the current billing period.

Each plan includes specific limits on the number of active forms, responses, and other features as described on the pricing page. Exceeding plan limits may result in restricted access to certain features until you upgrade or usage resets.

6. Acceptable Use Policy

You agree not to use the Service to:

• Collect data for any illegal, fraudulent, or unauthorized purpose.
• Create forms that impersonate other entities or are designed to deceive or phish respondents.
• Collect sensitive personal data (such as financial information, health records, or government identifiers) without appropriate legal basis and adequate safeguards.
• Send unsolicited or spam form links to individuals who have not consented to receive them.
• Circumvent, disable, or otherwise interfere with plan limits, rate limits, or other usage restrictions.
• Attempt to register multiple API keys by circumventing the one-per-IP restriction.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service in a way that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
• Distribute malware or use forms to redirect respondents to malicious content.

AgentForms reserves the right to suspend or terminate your access immediately and without notice if you violate this Acceptable Use Policy.

7. Data Ownership

Customer ownership: You retain full ownership of all Customer Data collected through forms you create using the Service. AgentForms does not claim any ownership rights over your data.

Form Respondent rights: Form Respondents retain ownership of the data they submit. By creating a form, you are responsible for ensuring that you have a lawful basis for collecting and processing the data submitted by Form Respondents.

Data Controller and Processor: As between you and AgentForms, you act as the data controller for any personal data collected through your forms. AgentForms acts as a data processor, processing Customer Data solely on your behalf and in accordance with your instructions as expressed through your use of the Service.

AgentForms will not sell, share, or use Customer Data for any purpose other than providing the Service, except as required by law or as described in our Privacy Policy.

8. Intellectual Property

The Service, including its design, code, features, documentation, trademarks, and all related intellectual property, is and remains the exclusive property of AgentForms. These Terms do not grant you any rights to use AgentForms' branding, logos, or trademarks without prior written consent.

You grant AgentForms a limited, non-exclusive license to use, store, and process Customer Data solely for the purpose of providing and improving the Service.

9. Data Retention

Form response data is retained according to your subscription plan:

• Free plan: Responses are retained for 7 days after submission.
• Pro plan: Responses are retained for 90 days after submission.
• Team plan: Responses are retained for 365 days after submission.
• Unlimited plan: Retention period as defined in your custom agreement.

After the applicable retention period, response data is automatically and permanently deleted from our systems. It is your responsibility to export or back up any data you wish to keep before the retention period expires.

If your subscription expires or is downgraded, the retention period of your current plan applies. Data that exceeds the retention window of your new plan may be deleted in accordance with the new plan's retention policy.

10. Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, AgentForms and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

In no event shall AgentForms' total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the total amount of fees paid by you to AgentForms during the twelve (12) months immediately preceding the event giving rise to the claim. If you are on the Free plan, AgentForms' maximum aggregate liability shall not exceed $50 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless AgentForms and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Any data collected through forms you create, including any claims by Form Respondents.
• Your infringement of any third party's intellectual property or other rights.

12. Service Availability

AgentForms strives to maintain high availability of the Service but does not guarantee any specific uptime or service level. The Service may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our reasonable control.

AgentForms is not liable for any interruption or cessation of the Service, whether planned or unplanned. We will make reasonable efforts to notify Users of scheduled maintenance in advance when possible.

13. Termination

You may stop using the Service at any time. If you are on a paid plan, you may cancel your subscription through the Lemon Squeezy billing portal.

AgentForms may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, the Acceptable Use Policy, non-payment, or extended inactivity.

Upon termination, your right to use the Service ceases immediately. AgentForms may delete your API key, forms, and associated data after termination in accordance with our data retention practices. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7, 8, 10, 11, and 14.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

15. Modifications to Terms

AgentForms reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where possible, provide notice through the Service or via email for Users on paid plans.

Your continued use of the Service after changes to the Terms constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription.
